Et aussi certaines diff\u00e9rences constat\u00e9es avec nos voisins fran\u00e7ais.<\/span><\/strong><\/p>\n<h6 class=\"p1\"><span class=\"s1\">Le restaurateur est-il oblig\u00e9 d\u2019offrir un \u2018gourmet bag\u2019 pour que le client emporte le reste de son assiette \u00e0 la maison ? M\u00eame si c\u2019est un buffet \u2018\u00e0 volont\u00e9\u2019 ?<\/span><\/h6>\n<p class=\"p2\">\u00ab Non, absolument pas. Le restaurateur n\u2019est pas tenu de proposer un \u2018gourmet bag\u2019 \u00e0 ses clients, que ce soit pour un repas classique ou un buffet \u2018\u00e0 volont\u00e9\u2019. \u00bb<\/p>\n<p class=\"p2\">\u2018Gourmet Bag\u2019 est un terme, une marque, qui a \u00e9t\u00e9 d\u00e9pos\u00e9e par le gouvernement fran\u00e7ais dans ce pays, le restaurateur peut toutefois facturer le contenant et aussi, \u00e9ventuellement, les bouteilles consign\u00e9es.<\/p>\n<h6 class=\"p1\"><span class=\"s1\">Est-il oblig\u00e9 d\u2019offrir une carafe d\u2019eau ?<\/span><\/h6>\n<p class=\"p2\">\u00ab Non, le restaurateur n\u2019a aucune obligation d\u2019offrir une carafe d\u2019eau en Belgique, contrairement \u00e0 la France \u00bb.<\/p>\n<h6 class=\"p1\"><span class=\"s1\">Les prix des plats\/menus doivent-ils \u00eatre affich\u00e9s \u00e0 l\u2019ext\u00e9rieur du restaurant ?<\/span><\/h6>\n<p class=\"p2\">\u00ab Oui, les prix des plats ou des menus doivent \u00eatre affich\u00e9s \u00e0 l\u2019ext\u00e9rieur du restaurant. C\u2019est une obligation l\u00e9gale \u00bb. En France, il est obligatoire d\u2019indiquer en ext\u00e9rieur \u00e9galement le prix indicatif de cinq vins ou le prix de tous les vins si, \u00e0 la carte, il y en a moins de cinq.<\/p>\n<h6 class=\"p1\"><span class=\"s1\">La non-acceptation ou le remplacement souhait\u00e9 d\u2019un plat\u00a0: estim\u00e9 pas frais, pas assez chaud, un libell\u00e9 trompeur (affich\u00e9 \u2018sole\u2019 alors que c\u2019est une \u2018limande\u2019)<\/span><\/h6>\n<p class=\"p2\"><span class=\"s2\">\u00ab Si le client peut prouver la fraude ou toute autre non-conformit\u00e9, il doit porter plainte aupr\u00e8s du SPF \u00c9conomie \u00bb. Par contre, la r\u00e9ponse est n\u00e9gative si celui-ci n\u2019appr\u00e9cie pas le plat en fonction de son go\u00fbt.<\/span><\/p>\n<h6 class=\"p1\"><span class=\"s1\">Refuser un client pour des motifs discriminatoires (religion, race, handicap, orientation sexuelle, enfants&#8230;)<\/span><\/h6>\n<p class=\"p2\"><span class=\"s2\">\u00ab Non, le restaurateur ne peut pas refuser un client pour des motifs discriminatoires. Cependant, encore faut-il que le client puisse prouver la discrimination \u00bb. Celle-ci peut porter sur la religion (d\u00e9montr\u00e9e sur le plan vestimentaire comme le voile), la race, le handicap, l\u2019orientation sexuelle). Mais le restaurateur peut exiger une \u2018tenue correcte\u2019 et interdire l\u2019entr\u00e9e de clients en short, en chaussures de sport, en burka\u2026 pour tenue inappropri\u00e9e. Il fut un temps o\u00f9 certains restaurants (comme \u2018La Villa Lorraine\u2019) exigeaient le port d\u2019une cravate.<\/span><\/p>\n<h6 class=\"p1\"><span class=\"s1\">L\u2019obligation de rembourser les frais de teinturier si le client est victime d\u2019un incident de service<\/span><\/h6>\n<p class=\"p2\">\u00ab Non, le restaurateur n\u2019est pas oblig\u00e9 de rembourser les frais de teinturier. Il s\u2019agit d\u2019un geste commercial, et le restaurateur doit \u00eatre couvert par une assurance en responsabilit\u00e9 civile. Si ce n\u2019est pas le cas, une plainte peut \u00eatre d\u00e9pos\u00e9e \u00bb.<\/p>\n<h6 class=\"p1\"><span class=\"s1\">Y a-t-il obligation, sur la carte, d\u2019indiquer l\u2019origine de la viande (+ \u00e9levage, abattage) comme en grande distribution ?<\/span><\/h6>\n<p class=\"p2\">\u00ab Non, le restaurateur n\u2019est pas tenu d\u2019indiquer l\u2019origine de la viande sur la carte \u00bb.<\/p>\n<h6 class=\"p1\"><span class=\"s1\">Peut-il refuser un client seul ?<\/span><\/h6>\n<p class=\"p2\">\u00ab Si toutes les tables sont r\u00e9serv\u00e9es, le restaurateur peut refuser un client seul. Dans le cas contraire, non, mais cela reste difficile \u00e0 prouver \u00bb.<\/p>\n<h6 class=\"p1\"><span class=\"s1\">Peut-il r\u00e9clamer un acompte en cas de r\u00e9servation ?<\/span><\/h6>\n<p class=\"p2\">\u00ab Oui, le restaurateur peut demander un acompte, voire le prix total, comme cela se pratique dans certains restaurants gastronomiques\u00a0\u00bb. Voil\u00e0 une pratique de plus en plus fr\u00e9quente \u00e0 cause du \u2018no show\u2019, des clients qui ont r\u00e9serv\u00e9 et ne se pr\u00e9sentent pas. A la r\u00e9servation, il doit informer le client des conditions d\u2019annulation lors de la r\u00e9servation (d\u00e9lais).<\/p>\n<h6 class=\"p1\"><span class=\"s1\">Le restaurateur peut-il attaquer en diffamation s\u2019il subit une mauvaise critique sur internet ?<\/span><\/h6>\n<p class=\"p2\">\u00ab Oui, un restaurateur peut attaquer en diffamation, mais il doit \u00eatre en mesure de prouver que les propos sont exag\u00e9r\u00e9s ou fallacieux \u00bb. En France, en principe, les tribunaux ne retiennent pas cet argument. Le restaurateur doit \u00e9tayer les faits avec pr\u00e9cision et objectivit\u00e9.<\/p>\n<h6 class=\"p1\"><span class=\"s1\">Peut-il refuser un client venu pour simplement boire un caf\u00e9\u00a0?<\/span><\/h6>\n<p class=\"p2\">\u00ab Cela d\u00e9pend du type d\u2019\u00e9tablissement. Dans un restaurant classique, il est possible de refuser ce type de demande, car le restaurateur reste ma\u00eetre de la gestion de son \u00e9tablissement \u00bb. En France, le client peut condamner ce refus.
